Terms and Conditions of Supply

TERMS AND CONDITIONS OF SUPPLY

The following terms and conditions are the Company’s standard terms.
These conditions are intended for the sole purpose of providing peace of mind to our customers and is an expression of our confidence in the quality, price and general value for money offered in our products. It is not a clever marketing tool with several opt-out clauses, but for this reason the few terms and conditions we do stipulate need to be rigidly implemented.
Individual agreements signed by Husky Directors may replace these terms in certain instances.
1. All terms are strictly cash with order unless otherwise agreed in writing by a Director.
2. Where a credit facility is granted, non-payment by the agreed date will result in interest charges of 2% above base rate until paid in full.
3. Goods remain the property of Husky until paid for in full.
4. Orders cancelled by the customer will incur a 25% handling fee to cover the cost of transport, administration, testing and repackaging costs.
5. Note, many cabinets refer to generic size names. Please check actual dimensions. It is the customer’s sole responsibility to check the dimensions to ensure suitability and access at the time of the order. We reserve the right to change specifications without prior notice.
6. Prices include delivery. Delivery is to the door unless previously confirmed in writing.
7. Value Added Tax. All prices quoted are exclusive of VAT, which will be added at the appropriate rate at the time of invoice.
8. Delivery is to UK mainland only. We will endeavour to meet delivery deadlines but cannot be held liable in any way for failure to do so.
9. Ownership. Title in goods supplied does not pass to the purchaser until payment for the goods has been received in full.

11. Prices exclude storage. Tariff available on request.
12. A bank charge of £25 will be charged for any cheque returned by the bank.
13. Deliveries postponed or delayed by the customer will incur a demurrage (storage charge).
DAMAGED SHIPMENTS
PLEASE READ AND UNDERSTAND THIS SECTION

1. All shipments must be thoroughly inspected for any sign of damage BEFORE signing the carrier’s delivery note. If there is damage, immediately ask the driver to phone Husky Transport department who will then obtain details, and ascertain the course of action.
2. If the shipment is to be stored packaged, please sign as “not seen.” Any damage must then be advised in writing within 24 hours of receipt.
3. Claims for damage cannot be accepted where the recipient has signed for receipt in good condition.
WARRANTY 1. Husky warrants that its product will be provided with the following warranty as standard for commercial equipment only

One Year Parts and Labour Warranty – commercial range: glass door cabinets, multidecks, freezers and ice machines.
One year parts and labour warranty – remote cooling systems; air conditioning systems.
Specific warranty agreements may supercede the above providing they are signed in advance by a Director.
2. Warranty is void if the equipment has not been maintained, or located and installed in accordance with Husky recommendations.
3. Warranty excludes physical damage, other than through normal wear and tear, and consumables such as light tubes, etc.
4. This warranty will automatically cease if the product has been neglected or misused or modified in any way, or if any of its parts have been replaced by a type not specified by Husky.
5. The warranty period for equipment or components that are exchanged under warranty will not be extended beyond the original period.
6. Warranty claims will only be limited to the warranty terms provided (this is also confirmed for reference on your invoice). No claims for labour, stock or any other losses will be accepted.
7. Repaired parts will be given on an exchange basis.
To make a claim, the following information must be supplied prior to the shipment of parts:
a) Serial Number
b) Original Invoice Number
c) Model Number
8. Ice machines and glasswashers must be fitted with a commercial water filter. Failure to do so will void the warranty.
9. WASTE ELECTRICAL AND ELECTRONIC EQUIPMENT DIRECTIVE: The buyer shall comply with the supplier, instructions in relation to the
Waste Electrical and Electronic Equipment Directive (2002/96/EC) as amended from time to time and such regulations as shall come into force to enact the provisions of the directive in the United Kingdom as amended from time to time. For the avoidance of doubt the buyer shall only dispose of the goods as directed from time to time by the supplier.
In the case of sales to businesses, the supplier reserves the right to charge the buyer a fee for removal and any goods that the new goods to be supplied by the supplier to the buyer can reasonably be said to be replacing.
'Internet-Only' Offers 1. Discounts apply only to selected offers as stated and to subsequent orders placed and paid for online.
2. It is the customer's responsibility to provide suitable access to the internet to place an order and makes payment online, concessions will not be given where access to the internet is not available.

4. Prices displayed may change without notice. Where price changes occur between the placing of an order and delivery, the price diaplayed on the Order Confirmation Email sent at the time of order will be honoured.

CARRIAGE: Our terms are cash & carry. However we will deliver FREE OF CHARGE to your premises on orders above £95.00 net of VAT. On orders under £95, the carriage charge is £5.95 plus VAT.  Delivery is based on a standard 3 working day service to mainland UK between the hours of 8am and 6pm.  Non standard delivery requests will be subject to charges.  Non mainland UK or Scottish highlands and Islands may be subject to charges.


DELIVERY: Please ensure that there is adequate access for larger items of equipment, as the company cannot be responsible for such a problem. Goods must be checked on receipt, before you sign the delivery note. If you sign the delivery note and have not checked the items we will not be held responsible for any claims that later arise through damage or missing items. Orders for next day delivery must be placed by 12 noon. Extra charge to be advised at time of placing order.
If an item is found to be damaged please mark “damaged” on the delivery note and inform our office immediately. All damages must be reported within 24 hours of receipt, otherwise we will not entertain claims.

RETURNS: Before returning goods, a returns number must be obtained from us. Unless the incorrect item has been received, a handling charge of 20% will be levied. Returns can only be considered if the goods are undamaged, unused and still in their original packing. Items to be returned must be notified within 7 days of receipt.
